Seasonal Permit Conversion in Italy: Not Automatic
A recent decision of the Regional Administrative Court of Tuscany confirms an important point: converting a seasonal residence permit into a work permit in Italy is not automatic.
Under Italian law, a seasonal worker must prove at least three months of regular work and present a valid job offer. In the agricultural sector, this is interpreted as a minimum of 39 working days over three months.
In the case examined by the Court (Judgment no. 329/2026), the worker did not reach the required threshold and argued that bad weather prevented him from completing enough working days. The Court rejected the appeal, emphasizing that such claims must be supported by concrete and documented evidence.
The message is clear: real work, proper documentation, and strict compliance with administrative criteria are essential.
